In a judgement that is likely to effect DUI convictions across North America, defense lawyers have won access to the proprietary source code in a popular model of breathalyzer, made by the CMI corporation of Kentucky. Thing is, the government does not own the rights to the code and therefore has no ability to hand it over, particularly because CMI is refusing to reveal its code for fear of revealing trade secrets. Because of this Catch-22, drivers charged with DUI may have an iron-clad defense at their disposal should they choose to employ it.
